House Republicans are pushing to make illegal Chinese vapes a trade priority

Congressional Republicans are urging the Trump administration to make illegal Chinese-made e-cigarettes a top trade and law enforcement priority, positioning the issue as a public health concern and a political gain through 2026.

“As trade negotiations with the People’s Republic of China (PRC) continue, it is imperative that the United States Trade Representative (USTR) and the Treasury Department address the continued abuse of our trade system,” Rep. Mike Carey, R-Ohio, wrote in a joint letter from 70 House Republicans to USTR Jamieson Greer and Treasury Secretary Bessence.

“Any new trade agreement with China should require that the Chinese government, through its oversight of e-cigarette exports, take drastic measures to stem the flow of illegal, youth-oriented cigarettes that are in clear violation of US and Chinese law.”

Cracking down on unlicensed imported vapes allows Republicans to combine anti-China messaging, child protection propaganda and law and order enforcement into one issue, a GOP operative running through the 2026 term told Fox News Digital on Thursday.

That makes it especially attractive in battleground states, where candidates tend to look to broad, pressured bodies that can win over independents and partisans in 80-20 battleground states.

“Cracking illegal Chinese vapes isn’t just smart policy — it’s what voters want, and members of Congress are right to stand up for it,” the agency wrote in a statement.

Rep. Zach Nunn, R-Iowa, warned this week that unauthorized devices from China are showing up in Iowa communities.

“Illegal Chinese vapes designed to hook kids on nicotine are popping up in Iowa communities, and the FDA hasn’t approved any of them,” Nunn wrote in X. “As a father of six children, I fight for myself.”

Federal and state authorities under President Donald Trump have created a long list of actions to enforce the layoffs.

In one of the largest operations, Health and Human Services, through the Food and Drug Association, and Customs and Border Protection said they seized 4.7 million units of unauthorized e-cigarettes in Chicago with an estimated retail value of $86.5 million, calling it the largest seizure of its kind.

Separately, the FDA and CBP announced another operation in Chicago involving nearly 2 million unlicensed electronic cigarettes with an estimated street value of $33.8 million.

The wide-ranging administrative cuts have extended beyond entry points. In September 2025, the DEA said its “Operation Vape Trail” seized more than 2.3 million vape devices and cartridges and more than 100 weapons during a nationwide law enforcement effort targeting illegal items in vape shops.

Also, in Virginia, “Operation Magic Dragon” targeted vape sales centers linked to broader criminal activity, with authorities reporting seizures that included drugs and firearms.

That enforcement record helps explain why Republican strategists see the issue as an unusually politically charged one.

“Any candidate who doesn’t make this issue a priority is leaving votes on the table that could potentially help President Trump re-secure his trifecta,” the GOP operative concluded.
