Hawaii doctor honored for ‘digital spying’ on wife in attempted murder case

Prosecutors pressed a Hawaii doctor accused of trying to kill his wife during cross-examination Thursday, challenging his story about a violent altercation on a hiking trail on Oahu.

Gerhardt Konig, who testified the day before his wife attacked him first, faced direct questions about his actions, his attitude and his behavior in the months leading up to the incident.

During cross-examination during his trial, Konig admitted that he went into what he described as “detective mode,” which he said began even before he accessed the WhatsApp messages. He agreed to track down his wife and review her communications.

He pointed out that WhatsApp is the most used program and he confirmed that he had checked his emails, and he said he agreed.

Konig admitted that although the messages did not contain graphic sex, she was upset by the level of the relationship.

“I was upset,” he told the jury, explaining that his reaction was not to a single message, but to the general nature of the communication.

Prosecutors pressed him again on his language, and Konig admitted to calling his wife nasty names, though he said that didn’t happen during his initial disclosure.

He revealed that he wanted his wife to leave him at work and he prefers that he no longer communicate with his colleague who he allegedly had an affair with.

Without the presence of the judge, the lawyers clashed over the allowed questions during cross-examination.

The state said the defense opened the door to questions about sexual coercion, including whether Konig wanted sex or threatened to reveal confidential information.

The judge ruled that prosecutors can question Konig about the sexual demands, but they can’t see them as coercion.

The court also allowed limited questions about what was described as “digital espionage,” including allegations Konig logged into his wife’s accounts, used an iPad to monitor her communications, and mirrored her phone to view emails and text messages.

The cross-examination follows Konig’s dramatic testimony on Wednesday, in which he said his wife attacked him first during a violent struggle on the road.

He told jurors that the argument escalated after an argument over allegations that he was having an affair.

Konig testified that his wife shoved him, grabbed him, and hit him with a rock. He admitted that he hit her twice, and said that he acted on his own initiative in self-defense.

He was also emotional on stage, telling judges he felt “scared” and “hopeless” after the incident.

Konig’s testimony came after two days of emotional testimony from family members, including her own son.

On Tuesday, Emil Konig told jurors that his father called him after the incident and said he tried to kill Arielle, but got away – a claim at the heart of the prosecution’s case.

Jurors also heard from Arielle Konig’s family, who described a strained relationship in the months leading up to the incident.

Peter Mast, Arielle Konig’s stepfather, testified that there was a “cooling off” in the relationship last year and said that at a party in late January, Konig appeared to act as if everything was normal.

Judith Mast, Arielle Konig’s mother, described the tension as “cold” between the couple, although she indicated that the relationship was better in the period before the incident.

Prosecutors say Konig attacked his wife in an attempted murder.

Konig pleaded not guilty.
